Temporary Vacancies:

The provisions concerning "Temporary Vacancies" in  the January 1, 2007 BLET/NS Agreement ARE NOT IN EFFECT, on NS.  Until further notice, temporary vacancy rules on the AGS District are to be adhered to, just as they were prior to the 2007 agreement printing (green book).

The following info is provided to clarify how AGS District engineer temporary vacancies are to be filled:

Extra Board Engineers: We continue to have many problems regarding the procedures regarding the claiming of temporary vacancies by engineers. Every time an engineer's job is open, it is a temporary vacancy. That does not mean the vacancy is claimable. When an outlying engineer lays off for a trip, that is a temporary vacancy. It is not claimable. The extra engineer does not have a displacement right after being relieved in the above situation.

Vacation vacancies: When an assigned (pool or carded) engineer goes on vacation ( scheduled, not a single day vacation), his/her job may be claimed by the senior engineer requesting the vacancy, prior to the start of the vacation period. This is a known vacancy. You must submit your request beforehand. In the event that the vacation vacancy was not claimed prior to 12:01 am on Monday, the vacancy may be claimed at any time thereafter. Secondary vacation vacancies are created by an assigned (pool or carded) engineer claiming a vacation vacancy. Engineer A goes on vacation. Engineer B claims engineer A's vacancy. Engineer B's assignment may be claimed on the first day. That is where it stops. Nobody can claim  the next engineer's  vacancy, created due to engineer A going on vacation and engineer B claiming his/her job, until it's (that 3rd vacancy)  been opened six days. That 3rd vacation related vacancy must be worked off of the extra board for six days, before it is claimable as a temporary vacancy.

Personal Leave and single day vacations: Neither may be claimed, at this time, under the temporary vacancy provision, even when they immediately precede a scheduled vacation week. They are not known in advance under the rule.

When an engineer is holding a temporary vacancy and he/she goes on vacation, the vacation assignment that is claimable is the assignment that he/she was working when the vacation began, not the job to which that engineer was regularly assigned and not working. Engineer A holds NC01 as a regular assignment. He/she is holding a temporary vacancy on SC02, when he/she begins their vacation. The vacation vacancy claimable when engineer A goes on vacation is the temporary vacancy he/she held just prior to going on vacation. In this case, the claimable vacation vacancy would be on job SC02, not his/her regular assignment  of NC01.

Engineer marked off sick, injured, pending, etc: Such a vacancy is not a 'known vacancy'. The engineer may or may not be allowed to mark up the very next day.  Just because one or  two individuals are aware that the engineer is going to be marked off for 3 weeks, does not make the vacancy a 'known vacancy'.

A senior engineer may displace to any temporary vacancy on the seventh day of the vacancy. The displacement request must be made prior to midnight of the 6th day of the vacancy.

At the time, when the temporary vacancy rule, as prescribed in the 2007 (green book) agreement is placed in effect, notification will be provided as to the appropriate application on the AGS District.
